Our Commitments

This privacy policy (hereinafter referred to as “the Policy”) specifies how Shanghai Chuangmi Technology Co., Ltd. (hereinafter referred to as “Chuangmi” or “we”) collect, use, disclose, handle and protect the information you provide for us while using intelligent camera products and services. Where you are required to provide some information to verify your identity before using intelligent camera products and services, we will use the information in strict accordance with the Policy and/or our user terms and conditions.

We have taken your demand into consideration while preparing the Policy. Always see to it that you have known our collection and use conventions of personal information comprehensively and could provide all the information for us.

“Personal information” in the Policy refers to the specific personal information able to be recognized once linked to the information and other personal information Chuangmi can access. Such personal information includes your name, address, phone number and email address.

In case of using intelligent camera products and services, you are seen to have read, recognized and accepted all terms and conditions herein, including any change made by us at any time. We hereby commit to protect privacy, confidentiality and security of your personal information in accordance with applicable laws (including data protection laws and regulations of your place). We also make sure that all our staffs and agents will perform these obligations.

Information and How It Is Collected

Information Collected

For the convenience of service provision, we will ask you to provide some personal information necessary for the service. We may be unable to provide our products or services for you if you refuse to provide the information.

We collect the following information (whether personal information or not):

• Device information: Relevant information on hardware, performance and status of your device, e.g. device MAC address, device name and status, (online/offline) and system version.

• Network information: WIFI SSID and device RSSI and IP.

• Remote video watch: We may provide remote real-time video or video replay function for you via “remote view watch”. The transmission is aimed at providing services for you and will not be saved in server.

• Our designated information related to you: We may collect and use such information as Xiaomi Account.

• Home watch: when "home watch" is turned on, pictures will be taken and uploaded to the server after objects move, human shape detection and abnormal sound. Users can view the picture through their mobile phones, and the picture will be saved on the server for 3 days.

Use of Personal Information

We collect personal information as per applicable laws for the purpose of providing services and/or products for you. You hereby agree us to process your personal information for the purpose as agreed herein and disclose your personal information to our affiliated company (e.g. communication, social media, technology and cloud business) and third-party service provider (as defined below).

We may use your personal information for the following purposes:

• Collect your device and network information to provide more suitable service for different device terminals; perceive intelligent terminal device information carried under identical WIFI, to realize device interconnection and seamless connection while using products and services in different device rooms.

• Exchange with you about your device, service or any ordinary inquiry (e.g. updating, customer consultation support, relevant information of our activity and notice).

• Analyze and develop statistical information about the use of our products and services to improve our products and services.

Details on how we use your information (personal information may be included).

• Enable “remote video watch” upon your selection and approval to provide remote real-time video or video replay function for you. You can disable this function at any time.

• Use device information to calculate quantity of activated devices and on-line devices, analyze firmware version distribution to inquire work status of specific device and make sure your device access has been authorized and protected.

• Use network information to analyze device network status to assist you in resolving operational problem. Besides, use IP information further to make rough statistics for geographic position distribution of on-line device, by which your any other information (e.g. geographical position information) will NEVER be disclosed.

• Use Xiaomi Account to inquire the device bound with the account, to make sure every device access is authorized.

Who do we share your information with?

We never sell any personal information to a third party.

We may disclose your personal information to a third party (as defined below) sometimes after obtaining your approval, as per laws and regulations or just for the purpose of realizing products or services.

You hereby acknowledge that we may disclose your information to a third-party service provider or affiliated company as listed in following text of this part (if any). You shall know under any cases as described below, Chuangmi will specify the third party’s practice and obligations in the form of contract and abide by applicable local data protection law when sharing your personal information with the third-party service provider. Chuangmi will make sure through contract that all third-party service providers will abide by privacy right standards applicable to themselves within your judicial district.

Information Shared with Our Group and Third-party Service Providers

To facilitate business and provide all functions of products and services, you agree we may disclose your personal information to other affiliated company of Chuangmi (e.g. communication, social media, technology or service) or our third-party service provider (our mail store, delivery service supplier, Telecom, data center, data storage facility, customer service provider, advertising and marketing service provider and Chuangmi’s agent) from time to time. Such third-party service providers may process your personal information on behalf of Chuangmi for one or multiple purposes. Information Shared with Our Ecosystem Company

Xiaomi, in partnership with some companies, constitutes Xiaomi’s ecosystem. Xiaomi’s ecosystem company is an independent entity invested and operated by Xiaomi and the expert of these fields. You agree Chuangmi may disclose your personal information to Xiaomi or other Xiaomi’s ecosystem companies in order to provide and improve the marvelous products and services from Xiaomi’s ecosystem (including hardware and software). Xiaomi/Mijia/Mitu brand may be used still in some product and service, but other products and services may have their own brands. Xiaomivs ecosystem company may share relevant data of products and services of Xiaomi brand with Xiaomi from time to time, to provide software and hardware services and bring better function and user experience. Where Chuangmi participates in merger, acquisition or sales of its assets (either in whole or in part), we will notify you of all the changes of ownership and use of your personal information and any choice you may own about your personal information by email and/or issuing striking notice via our website.

Information Shared with Others

If requested by applicable laws, Chuangmi may disclose your personal information without a prior notice.

Information Shared with No Consent

We may share anonymous information with a third party (e.g. advertising agency on our website) in the form of summary for business purpose. We may share general usage trend of our services with the third party, such as quantity of customers among the specific population purchasing certain product or conducting certain transaction.

For the avoidance of doubt, Chuangmi will collect, use or disclose your personal information without your consent to the extent explicitly permitted by local data protection laws and only under such circumstances. Such disclosure may be made to safeguard our rights and interests, ensure the safety of you and others and assist in investigating illegal activity at the request of local government.

Safety Guarantee

Our Safety Measures

We commit to ensure the security of your personal information. To prevent unauthorized access, disclosure or other similar risks, we have implemented reasonable physical, electronic and management measures to protect the information we collect while you are using intelligent camera products and services. We adopt all possible reasonable measures to protect your personal information.

For example, after accessing Xiaomi Account, you can ensure the security better through the two-step verification procedure. After you send to our server or receive information through Chuangmi device, we commit to make encryption through security socket layer (SSL) and other algorithm.

All your personal information is saved in a safe server and protected by controlled facility. We classify your data based on importance and sensitivity and make sure your personal information is at the highest safety level. We commit the employees and third-party service providers providing products and services for you by accessing the information have performed strict contract confidentiality obligations and will be subjected to disciplinary punishment or the cooperation termination once they fail to abide by the obligations in good faith. Similarly, we have established special access control measures for cloud-based data storage. All in all, we will review information collection, storage and processing practice at regular intervals (including physical safety measures), to avoid any unauthorized access and use.

We will take any feasible measures to protect your personal information. However, you should be aware that the use of Internet is not always safe. Therefore, we cannot ensure the security or integrity of any personal information during two-way transmission of Internet.

Your Deeds

• Do not disclose your login password or account information to anyone (except for the person obtaining your formal authorization) to ensure the security of your personal information. Whenever you log in as a user of Xiaomi Account and particularly via others’ computer or public Internet terminal to use intelligent camera products and services, you shall log out after use.

• Chuangmi assumes no responsibility for your safety omission ascribed to a third party accessing your personal information resulted from your failure to keep privacy of personal information. Notwithstanding the above provisions, you shall notify us immediately in case that any other user of Internet uses your account without authorization or there is any other security hole.

• Your assistance facilitates our privacy protection for your personal information.

Our Reservations

We will keep saving your personal information as long as it is required for realizing the purpose of collection or agreed or permitted by applicable laws. We will not retain your personal information or will cancel the approach of connecting personal information and particular individual as long as the retention of personal information can be reasonably inferred unable to realize the purpose of personal information collection (including the situation where personal information is no longer needed for resolving legal dispute, applying our agreement or realizing our business purpose). Where you cancel your account or delete your personal information actively, we will protect your personal information in accordance with laws and regulations (e.g. Internet Security Law). After you cancel your account or delete your personal information actively, we will not use your personal information any longer, unless otherwise requested by laws; but we may use your personal information after anonymous processing.

Accessing Other Functions of Your Device

Our application program may access some functions of your device, e.g., Wi-Fi network status and other functions. With the information, our application program could be run on your device and interact with you. You can close application program at device level or cancel permission by contacting us via privacy@imilab.com.

You can control your information!

Control Setup

Chuangmi acknowledges different people may concern privacy from different points. Therefore, we provide some cases to explain the various methods provided by Chuangmi for your choice, so as to restrict the collection, use, disclosure or processing of your personal information and control your privacy setup.

• Agree/disagree when privacy window pops up

• Turn on/off video streaming

• Enable/disenable motion detection alarm

• Agreement cancellation. Upon user’s confirmation, all cloud and local data will be deleted and device will restore to reset mode.

If you have agreed us to use your personal information for the above purpose, you may also change your device by sending us an email via privacy@imilab.com.

Accessing, Updating, Correcting or Erasing Your Personal Information

•You have the rights to access and/or correct any personal information related to you we hold. Where you have updated your personal information, your identity shall be verified before processing your request. Once we obtain sufficient information and can deal with your access or correct your personal information request, we will respond to your request within the time as specified by data protection law.

•We provide these services for free in general, but reserve the right to charge reasonable fee for your data access request.

• Please contact us ASAP via privacy@imilab.com, if you decide to access your personal information we hold or believe any of your information we hold is incorrect or incomplete or improper or excessive.

•For personal information-related details in your Xiaomi Account, you can access and change it via http://account.mi.com or device login account.

Agreement Cancellation

You can cancel your agreement on our collection, use and/or disclosure of your personal information we master or control in the form of a request by cancelling the agreement on privacy and protocol through general setup. We will process your request within a reasonable time upon your request by you, and will never collect, use and/or disclose your personal information according to your request thereafter.

We hereby remind you: Your agreement cancellation will lead to some legal consequences: According to the scope of your personal information we can no longer get access to based on your cancellation, you may no longer enjoy the intelligent camera products and services.

Transfer your personal information beyond your judicial district

If we need to transfer your personal information beyond your judicial district either to our affiliated company (e.g. communication, social media, technology and cloud business) or third-party service provider, we will make transfer as per applicable laws. Particularly, we will make sure all such transfers satisfy requirements of applicable local data protection law by implementing proper safety guarantee measures.

Chuangmi may use overseas facility that we run or control to process or back up your personal information. At present, Chuangmi has established data center in Beijing, the US, Singapore and Europe. These overseas judicial districts may or may not have data protection law substantially similar with the data protection law of your judicial district. We may transfer and save your personal information in our overseas facility, but this does not change our all commitments on complying with your privacy policy and safeguarding your personal information.

Miscellaneous

Juveniles

We believe it is parents’ responsibility to supervise their children to use our products and services. But according to our policy, it is forbidden to obtain juveniles’ personal information or send any promotional data to them.

Chuangmi will not seek or attempt to seek and receive any personal information from juveniles. If the parent or guardian has a reason to believe their children submit personal information to Chuangmi without their advance approval, please feel free to contact us to delete such personal information and make sure the children cancel the subscription of any applicable service of Chuangmi.

Order of Precedence

In case of any inconsistency between user agreement you agree and the Policy, the former shall prevail.

Privacy Policy Updating

We will check the Policy at regular intervals, and may also update it to reflect the change of our information conventions. In case of a major change of the Policy, we will notify you by email (email sent to the email address of your designated account) or via Chuangmi’s website or mobile device, so that you could know our collected information and how we use the information. The change of privacy policy comes into effect upon the effective date as specified in notice or website. You are suggested to check webpage regularly to obtain the latest information of our privacy practice. You are seen to accept the updated privacy policy if continuing to use the products and services on website, mobile phone and/or any other devices. We will obtain your approval again before collecting more personal information from you or using or disclosing your personal information for any other purpose.

Do I have to agree on terms and conditions of any third party?

The Policy is inapplicable to products and services provided by any third party. Intelligent camera products and services may include products and services of a third party and link of the third party’s website. Your information may be collected while you using these products and services. Therefore, you are highly suggested to spend time reading privacy policy of the third party, just as ours. We neither assume responsibility for third party’s use for the personal information collected from you nor control the use. The Policy does not apply to other websites linked through our service.
